Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Pumi Stories mobile application and related services (collectively, the “Services”). The Services are operated by Pumi Technologies Inc (“Company,” “we,” “us,” “our”).

By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1) Important Summary

• The Services are intended for parents and legal guardians (“Parents”).

• The Services may generate stories, images, and other outputs using automated systems (“AI”). Outputs may be imperfect.

• If you upload content (including a child’s photo), you remain responsible for your content and you grant us rights needed to operate the Services.

• Subscriptions purchased through app stores are subject to store billing terms.

• The Services are provided “as is,” and our liability is limited to the maximum extent allowed by law.

2) Eligibility; Parents Only

The Services are intended for adults who are Parents or legal guardians. You must be at least 18 years old (or the age of majority where you live) to create an account and use the Services.

Children may view or listen to content through a Parent’s account, but may not create accounts or submit personal information without Parent involvement. You are responsible for supervising your child’s use.

3) Accounts and Security

You may need an account to use certain features. You agree to:

• provide accurate information,

• maintain the security of your account credentials,

• promptly notify us of any unauthorized use, and

• accept responsibility for activity that occurs under your account.

We may suspend or terminate accounts as described in Section 14.

4) Privacy

Our processing of personal data is described in our Privacy Policy (the “Privacy Policy”), which is incorporated into these Terms by reference. If these Terms conflict with the Privacy Policy on a privacy topic, the Privacy Policy controls.

5) Subscriptions, Billing, and Auto-Renewal

5.1 App Store / Google Play Purchases

If you purchase a subscription or in-app purchase through Apple App Store or Google Play, the store is the merchant of record and handles billing. Your purchase is also subject to the store’s terms and policies.

5.2 Auto-Renewal

Subscriptions typically auto-renew unless you cancel through your app store account settings before renewal. The renewal price will be the price displayed at purchase (or as updated with notice where required).

5.3 Trials and Promotional Offers

If we offer a free trial or discount, trial eligibility and conversion terms will be disclosed at sign-up. Unless disclosed otherwise, trials convert to paid subscriptions automatically unless canceled before the trial ends.

5.4 Refunds

Refunds for store purchases are handled by the applicable store under its policies, except where we are required by law to provide additional rights.

5.5 Changes to Pricing or Plans

We may change pricing, plan features, or offerings from time to time. If required, we will provide notice before changes take effect for active subscribers.

6) The Services and AI-Generated Outputs

6.1 Generated Content

The Services may generate content such as stories, text, illustrations, and other outputs (“Generated Content”). Generated Content is produced by automated systems and may:

• be inaccurate, incomplete, or not suitable for your intended purpose,

• contain errors, inconsistencies, or unexpected results,

• be similar to content generated for other users.

6.2 No Professional Advice

The Services and Generated Content are for entertainment and general informational purposes and are not medical, psychological, therapeutic, legal, safety, or other professional advice. You are responsible for how you use the Services and for supervising what your child sees or hears.

6.3 Safety and Appropriateness

We aim to provide family-friendly content, but we do not guarantee that all Generated Content will be appropriate in every context. You agree to use parental judgment and supervision.

6.4 Service Changes

We may add, remove, or modify features at any time, including imposing limits on usage to protect the Services, comply with law, or prevent abuse.

7) User Content; Your Responsibilities

7.1 “User Content”

“User Content” means anything you submit, upload, or provide to the Services, including prompts, text inputs, feedback, and images (including child photos).

You represent and warrant that:

• you own or have all necessary rights to your User Content,

• your User Content does not infringe any third-party rights (including privacy, publicity, and intellectual property rights),

• if your User Content includes a child’s data or a child’s photo, you are the Parent/legal guardian (or have obtained valid consent from the Parent/legal guardian) and you are authorized to provide it.

7.2 Child Photos and Child Data

If you upload a child’s photo or other child-related information, you acknowledge:

• we will process it to provide requested features (e.g., story personalization, stylized illustrations),

• you should not upload sensitive information you do not want processed,

• you can request deletion as described in Section 15 and the Privacy Policy.

7.3 Prohibited Content

You may not submit User Content that:

• is unlawful, abusive, harassing, hateful, or sexually explicit,

• exploits or harms children in any way,

• contains malware or attempts to disrupt the Services,

• violates privacy laws or requests personal data about others,

• infringes intellectual property or other rights.

8) License You Grant Us (Needed to Run the App)

You retain ownership of your User Content as between you and us. However, to operate the Services, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, modify (e.g., format/resize), create derivative works from (as necessary to provide outputs), and display your User Content solely:

• to provide, maintain, and improve the Services,

• to generate and deliver Generated Content you request,

• for security, compliance, and abuse prevention.

This license ends when your User Content is deleted from our systems, subject to limited retention described in the Privacy Policy (e.g., backups, security logs, legal compliance).

9) Our Intellectual Property

The Services, including software, designs, trademarks, logos, and overall look and feel, are owned by us or our licensors and are protected by law. Except for the rights expressly granted to you, we reserve all rights.

You may not copy, modify, reverse engineer, sell, rent, or distribute the Services or any part of them except as permitted by law.

10) Ownership and Use of Generated Content

As between you and us, and to the extent permitted by law:

• We grant you a personal, non-transferable license to use Generated Content for personal, non-commercial use (e.g., reading/listening at home, saving in your library).

• You may not use Generated Content in a way that violates law, infringes rights, or is harmful.

• If you want commercial rights (e.g., publishing/selling Generated Content), contact us first at service@pumistories.com.

We may use aggregated and de-identified information about how the Services are used to improve the Services (see Privacy Policy). We do not need your permission to fix bugs, run analytics, or prevent abuse.

11) Acceptable Use

You agree not to:

• use the Services for illegal activities,

• attempt to access others’ accounts or data,

• scrape, crawl, or extract data at scale,

• bypass rate limits or access controls,

• interfere with or disrupt the Services,

• use the Services to generate or distribute harmful or exploitative content (especially involving minors).

We may investigate and take action, including content removal and account termination.

12) Third-Party Services and Links

The Services may rely on third-party services (e.g., hosting, analytics, crash reporting, and AI processing) and may link to third-party websites. We are not responsible for third-party services, and your use of them may be subject to their terms and policies.

13) Copyright Complaints (DMCA-Style Process)

If you believe content on the Services infringes your copyright, contact service@pumistories.com with:

• identification of the copyrighted work,

• identification of the allegedly infringing material,

• your contact information,

• a statement of good-faith belief,

• a statement under penalty of perjury that the information is accurate and you are authorized to act.

We may remove or disable access to content and may terminate repeat infringers where appropriate.

14) Termination and Suspension

You may stop using the Services at any time. We may suspend or terminate your access if:

• you violate these Terms,

• we must do so to comply with law,

• your use creates risk or harm to the Services, users, or others,

• you attempt to abuse or reverse engineer the Services.

Termination may result in loss of access to stored content, subject to legal requirements and the Privacy Policy.

15) Deletion Requests

You may request account deletion by emailing service@pumistories.com from the email address linked to your account with the subject line “Delete My Account”.
You may also request deletion of specific child photos or content. We may need to verify your request.

Data retention is described in the Privacy Policy.

16) Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL GENERATED CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• the Services will be uninterrupted, error-free, or secure,

• Generated Content will be accurate, unique, or appropriate for every child,

• defects will be corrected immediately.

17) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL.

• OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US (IF ANY) FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. In those cases, liability is limited to the maximum extent permitted by law.

18) Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• your User Content (including child photos you upload),

• your use of the Services,

• your violation of these Terms,

• your violation of any law or third-party rights.

19) Dispute Resolution; Governing Law

19.1 Governing Law

These Terms are governed by the laws of Delaware, without regard to conflict of laws principles, except where your local consumer protection laws require otherwise.

19.2 Venue

If Section 19.3 (Arbitration) does not apply, disputes will be resolved in the state or federal courts located in Delaware, unless prohibited by applicable law.

19.3 Optional: Arbitration and Class Action Waiver (Recommended for U.S. Users)

If you reside in the United States, you and we agree to resolve most disputes through binding arbitration on an individual basis, and not in class actions, class arbitrations, or representative actions, except:

• you may bring claims in small claims court if eligible, and

• either party may seek injunctive relief for intellectual property misuse in court.

Arbitration will be administered by American Arbitration Association under its applicable rules.
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing service@pumistories.com with the subject “Arbitration Opt-Out” and including your account email and a clear statement that you opt out.

If you are outside the U.S., arbitration may not apply or may be limited by local law; in that case, Section 19.2 applies.

20) Export and Sanctions Compliance

You may not use the Services if you are prohibited under applicable export control or sanctions laws, and you agree not to use the Services in a manner that violates such laws.

21) Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control (e.g., outages, natural disasters, war, labor disputes, internet disruptions).

22) Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice as required (e.g., in-app notice). Your continued use of the Services after the effective date of revised Terms constitutes acceptance.

23) Miscellaneous

• Entire Agreement: These Terms and the Privacy Policy are the entire agreement between you and us regarding the Services.

• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

• No Waiver: Failure to enforce a provision is not a waiver.

• Assignment: You may not assign these Terms without our consent; we may assign them as part of a corporate transaction.
